Terms of Sale
Version in force as of October 21, 2026.
These Terms of Sale were written in French and translated into English. This English version is provided for convenience: if the two versions differ, the French version prevails (see article 20).
1. Scope
These Terms of Sale (the “Terms”) govern the sale, on the website https://escape-chill.com (the “Site”), of digital escape room games (the “Games”) by the seller named in article 2, to consumers. Placing an order means you accept them. The online checkout is for consumers, meaning private individuals buying for personal purposes outside any business activity; it is not set up for business purchases, including VAT-exempt purchases with an EU VAT number. Requests from businesses (team building, events) are handled by quote, under separate terms.
2. Seller
Escape & Chill is a brand of Rémi Bouvant EI, a sole proprietor (French micro-enterprise, “entrepreneur individuel”), headquartered at 6 rue d’Amance, 13012 Marseille, France, registered under SIRET 904 286 713 00014 (French business ID) (French National Business Register (Registre national des entreprises)). VAT: EU VAT number FR41904286713. Contact: contact@victoire-digital.fr, +33 7 81 19 13 75.
3. The Games and system requirements
Each Game is digital content delivered online, with no physical medium. It is played in a web browser: a main screen (a computer connected to a TV, or a computer on its own) shows the setting and the videos, and each player uses a phone with an up-to-date browser to receive their clues. An internet connection is required throughout the play session. A smart TV’s built-in browser may also work, but smooth playback is not guaranteed on every model. A play session has 1 to 4 players. The features of each Game (approximate length, recommended age, number of players) are on its page.
4. Account
You can buy without creating an account first: the Game is attached to the email address you give at checkout, which serves as your account. You log in with a link sent to that address; you can also choose a password if you want. You are responsible for access to your mailbox. Invited players join a play session without an account.
5. Prices
Prices are in euros and include VAT where applicable. They are shown on each Game’s page and on the pricing page. The price that applies is the one displayed when you place your order. The first room of each Game is free to play, with no payment. If your bank or card issuer converts euros into your local currency, its exchange rate and any fees are set by them, not by us.
Launch price. Through October 31, 2026 (Paris time), the Game is offered at €9.99, for all purchases (direct purchases and gift cards), with no limit on the number of purchases. After that date, the Game is sold at the price shown on its page. The launch price is not retroactive, and no price difference is refunded.
Loyalty price. When several Games are offered, a customer who already has at least one Game on their account can buy each of the other Games at a loyalty price, reserved for customers and lower than that Game’s public price. This price is shown on the purchase page before payment and applies automatically for as long as the customer has a Game on their account. It does not apply to gift cards.
Friend price. After buying a Game, the buyer receives a personal friend code at the end of their play session. It is valid for that Game only, for 30 days, and for no more than 5 purchases. A person who buys that Game with this code, or with the link that contains it, pays the friend price in effect when they order: €7.99 through October 31, 2026 (Paris time), then €10.99. The friend code does not apply to gift cards, and its holder cannot use it for their own account or email address. The seller may deactivate a friend code that is shared or used abusively.
Follow-up offers. The seller may email a personal offer to someone who started a Game without buying it, for example keeping the launch price for 72 hours, available through a personal single-use link.
No stacking. The launch, loyalty and friend prices and follow-up offers cannot be combined: when a customer qualifies for more than one, the lowest price applies.
6. Ordering
The customer chooses a Game, enters their email address (no account needed beforehand), checks the immediate-access box described in article 9, checks the summary (Game, price including VAT where applicable) and confirms payment. The order is final once payment is confirmed. A confirmation email is sent to the customer. It contains the order details, these Terms, and confirmation of the customer’s request for immediate access and acknowledgment that the right of withdrawal is lost.
7. Payment
Payment is due when you order. You can pay by bank card, Apple Pay or Google Pay, through the payment provider Stripe. Payment details are sent encrypted directly to Stripe and are never accessible to the seller.
8. Access to the Game
The Game is attached to the customer’s account as soon as payment is confirmed. The customer can start as many play sessions as they like. Other players join a session started by the customer for free. Access is granted for private use, among family and friends. Any commercial use, or any paid public showing, requires the seller’s written permission.
Access lasts as long as the Site operates the Game. If the Game is permanently discontinued, the customer will be told by email at least three months in advance.
9. Right of withdrawal
Consumers in the European Union normally have 14 days to withdraw from a contract made online. Under Article L221-28, 13° of the French Consumer Code (which implements Article 16(m) of EU Directive 2011/83/EU), that right does not apply to digital content that is not supplied on a physical medium if performance has begun with the consumer’s prior express consent and with the consumer’s express acknowledgment that they lose their right of withdrawal.
Because the Game is available immediately after payment, the customer must check the following box before paying: “I request immediate access to the game, and I acknowledge that I will lose my right of withdrawal as soon as access begins.” Unless this box is checked, the order cannot be completed. This consent and acknowledgment are confirmed to the customer in the order confirmation email.
The free room lets the customer try the Game before buying anything. If you live outside the European Union, whether you have a statutory right to cancel depends on the law of your country. The above applies to the extent that law allows, and nothing in these Terms removes a right that cannot be waived.
10. Gift cards
A customer can buy a Game as a gift, in the form of a gift card. The card is a single-use code, emailed to the customer and, if they choose, directly to the person receiving it (the “recipient”), along with the first name and message the customer entered. The customer is responsible for the accuracy of the address provided.
The card is valid for twelve months from the date of purchase. The recipient redeems it by logging in to an account on the Site: the Game is then added to their account, under the conditions of article 8, and the card is used up. If the recipient’s account already has the Game, the card is not used up and can be passed to someone else. A card cannot be exchanged for money or for a different Game, and cannot be used in part.
The code works as an access pass: the seller is not responsible if it is used by someone the customer or recipient gave it to. If an unused code is lost, the customer can write to contact@victoire-digital.fr to have it sent again.
Withdrawal. Because the digital content is only supplied when the card is redeemed, the customer has fourteen days from the purchase to withdraw without giving a reason, as long as the card has not been used, by writing to contact@victoire-digital.fr. They are refunded within fourteen days of their request, using the payment method they used, and the card is deactivated. Once the recipient has redeemed the card, the Game has been supplied and the right of withdrawal can no longer be exercised.
11. Leaderboard and team name
At the end of a play session, the team’s time may appear on the Game’s public leaderboard, with the team name chosen when the session started (or, if none, the first names entered by the players), the number of players and the date. The customer agrees not to choose a name that is insulting, discriminatory, contrary to public decency, or that infringes a third party’s rights. The seller may remove from the leaderboard any result that breaks these rules or comes from a test session.
12. Player reviews
Reviews published on the Site are verified reviews: only players who finished a play session can rate the Game, once per session, from their phone at the end of the session. Reviews are never paid for or rewarded. A review has a rating from 1 to 5 and, if the player wants, a comment. It is published with the first name entered to play, the number of players and the date.
A rating without a comment is published automatically. A comment is reviewed before publication, within seven days. It is only rejected if it is insulting, off-topic, contains personal data, or does not describe a real play experience. Negative reviews are published just like the others, and a published review is never edited. Reviews are shown from newest to oldest. The average rating takes all published reviews into account and only appears once there are ten reviews. A player can ask for their review to be removed by writing to contact@victoire-digital.fr. See also our review policy.
13. Legal guarantee of conformity
The seller must supply a Game that conforms to the contract and is liable for lack of conformity under Articles L224-25-12 and following of the French Consumer Code (which implement EU Directive 2019/770 on digital content). For digital content supplied in a single act, the seller is liable for any defect that existed when the content was supplied and that appears within two years of that date. The seller also provides the updates needed to keep the Game in conformity.
If the Game does not conform, the customer is entitled to have it brought into conformity free of charge and within a reasonable time. Failing that, or if the defect is serious, they can obtain a price reduction or terminate the contract with a refund. To use the guarantee, the customer writes to contact@victoire-digital.fr describing the problem and the equipment used.
The Game is designed to run on the setup described in article 3. A problem caused by equipment or a connection that does not meet those requirements, which the customer was told about before buying, is not a lack of conformity. If you live outside France, you may have similar statutory rights under your local consumer law, and nothing in these Terms limits them.
14. Liability
The seller uses reasonable means to keep the Site and the Games available. The seller cannot be held responsible for interruptions caused by the customer’s internet connection, announced maintenance, or events beyond its reasonable control (force majeure). Nothing in these Terms limits the rights a consumer has under the law.
15. Intellectual property
The Games and all their elements (videos, texts, images, sounds, puzzles) remain the property of the seller or its partners. A purchase gives you a personal, non-exclusive right to use the Game, with no transfer of ownership.
16. Personal data
Data collected when you order is handled in accordance with the privacy policy.
17. Complaints and mediation
Any complaint can be sent to contact@victoire-digital.fr. If a disagreement persists, and after a written complaint that has not been resolved, the customer can use the following consumer mediator free of charge, under Articles L612-1 and following of the French Consumer Code: CNPM Médiation de la consommation, 27 avenue de la Libération, 42400 Saint-Chamond, France, online at https://cnpm-mediation-consommation.eu/.
18. Governing law
These Terms are governed by French law. If you are a consumer living in the European Union, you also keep the benefit of the mandatory consumer protection rules of the country where you live. In the event of a dispute, the consumer may bring the case, at their choice, before the courts of the place where they lived when the contract was made or when the harmful event occurred, or before any other court that has jurisdiction under the law.
19. Changes to these Terms
The seller may change these Terms. The terms that apply are those in force on the date of the order; for a gift card, those in force on the date it was bought.
20. Language
These Terms were first written in French, the language of the seller’s country. This English version is a translation provided for convenience. If the two versions differ, the French version prevails, except where the mandatory law of your country of residence requires otherwise. You can read the French version at escape-chill.fr/cgv.
